This Privacy Policy describes how NOVATE.AI LLC, a Virginia limited liability company (“Novate,” “we,” “our,” or “us”), collects, uses, discloses, and protects information about you when you visit https://novate.ai (the “Site”), use our software applications (including Sample Miner, collectively the “Software”), or otherwise interact with us (together, the “Services”). By using the Services, you agree to the practices described in this Policy.
1. Scope of This Policy
This Policy applies to personal information we collect through the Services. It does not apply to information collected by third parties we do not own or control, including third-party websites that may be linked from the Services or third-party platforms from which you may download our Software (for example, app marketplaces). We encourage you to review the privacy policies of any third party before providing information to them.
2. Information We Collect
2.1 Information You Provide Directly
We collect information you submit when you contact us, request support, sign up for a newsletter or update list, purchase a license, participate in a beta program, or otherwise communicate with us. This may include your name, email address, country or region, company name (if applicable), and the contents of your messages to us.
2.2 Purchase and License Information
If you purchase a license for the Software, our payment processors (for example, Stripe or Lemon Squeezy) collect and process your payment details on our behalf. We do not receive or store full payment card numbers. We do receive confirmation of the transaction, the associated email address, the product purchased, the amount, and related metadata used to issue and verify your license.
2.3 Information Collected Automatically
When you visit the Site, we and our analytics providers may automatically collect certain information about your device and browsing activity, including IP address, approximate geographic location derived from IP, browser type and version, operating system, referring URL, pages viewed, links clicked, and the date and time of access. This information is used in aggregate to understand how the Site is used and to improve it.
2.4 Software Telemetry and License Verification
The Software may connect to our servers or to our third-party providers to verify license validity, check for updates, and transmit diagnostic information (such as anonymized crash reports and error logs) used to identify and fix defects. Where feasible, we aggregate or pseudonymize this information. Unless you contact us for support, we do not link diagnostic telemetry to your identity.
2.5 Information From Third Parties
We may receive information about you from payment processors, analytics providers, email delivery services, and platforms where we distribute the Software. This information is used only for the purposes described in this Policy.
3. How We Use Information
We use the information we collect to:
- operate, maintain, and improve the Services and develop new features;
- process transactions, deliver purchased licenses, and verify license validity;
- respond to your inquiries and provide customer support;
- send administrative communications, including service announcements, security notices, and changes to this Policy or our Terms of Use;
- send marketing communications, where permitted by law and subject to your ability to opt out;
- measure and analyze usage of the Services to inform product decisions;
- detect, investigate, and prevent fraud, abuse, and security incidents; and
- comply with applicable legal obligations and enforce our agreements.

If you are located in the European Economic Area, the United Kingdom, or Switzerland, we process your personal information on the following legal bases:
- Contract: to provide the Services you request, including fulfilling your license purchase.
- Legitimate interests: to operate, secure, and improve the Services, and to understand how they are used, where such interests are not overridden by your rights.
- Consent: for non-essential cookies, marketing emails, and other activities for which we seek your consent. You may withdraw consent at any time.
- Legal obligation: to comply with applicable laws, such as tax, accounting, and anti-fraud requirements.
5. Cookies and Similar Technologies
We use cookies and similar technologies to operate the Site and to understand how it is used.
- Strictly necessary cookies are required for the Site to function and cannot be refused through our cookie banner. They include, for example, preferences that record your cookie choice.
- Analytics cookies are set only if you accept them. We currently use Google Analytics (Google LLC) to measure Site usage. You can withdraw consent at any time by clearing your browser storage for this Site or using your browser's cookie controls.

6. How We Share Information
We do not sell your personal information. We disclose information only in the following circumstances:
- Service providers. Vendors that perform services on our behalf (for example, hosting, analytics, email delivery, payment processing, customer support, and license management). These providers are contractually limited to using information solely to perform services for us.

- With your direction or consent. When you ask us to share information, or consent to such sharing.
7. Third-Party Services We Use
We rely on reputable third parties to help us operate the Services. Categories currently include: cloud hosting, domain and DNS, analytics (Google Analytics), payment processing, email delivery, error monitoring, and license management. 8. Data Retention
We retain personal information for as long as necessary to provide the Services and to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law (for example, for tax, accounting, or legal compliance). When information is no longer needed, we delete or de-identify it. License and transaction records are typically retained for at least seven (7) years to meet financial and legal recordkeeping requirements.
9. International Data Transfers
Novate is based in the United States, and the Services are operated primarily from the United States. If you access the Services from outside the United States, your information will be transferred to, stored in, and processed in the United States and other jurisdictions where our service providers operate. These jurisdictions may have data protection laws different from those of your country. Where required by law (for example, for transfers from the EEA, UK, or Switzerland), we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses.
10. Your Privacy Rights
10.1 Rights Under EEA, UK, and Swiss Law
If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the right to: (a) access the personal information we hold about you; (b) request correction of inaccurate or incomplete information; (c) request erasure of your information; (d) request restriction or object to certain processing; (e) request data portability; and (f) withdraw consent where processing is based on consent. You also have the right to lodge a complaint with your local data protection authority.
10.2 Rights Under California Law
If you are a California resident, you have the right to: (a) know what personal information we collect, use, disclose, and sell (we do not sell personal information as defined by California law); (b) request deletion of your personal information; (c) request correction of inaccurate information; (d) opt out of the "sale" or "sharing" of personal information for cross-context behavioral advertising; and (e) not be discriminated against for exercising your rights. You may designate an authorized agent to make a request on your behalf.
10.3 Rights Under Other U.S. State Laws
Residents of other U.S. states (including Virginia, Colorado, Connecticut, Utah, and others) may have rights similar to those described above under applicable state privacy laws. We respond to verified consumer requests in accordance with those laws.
10.4 How to Exercise Your Rights
To exercise any of these rights, contact us at contact@novate.ai. We may need to verify your identity before responding. We will respond within the timeframe required by applicable law. These rights are not absolute and may be subject to legal exceptions.
11. Children's Privacy
The Services are not directed to children under thirteen (13), and we do not knowingly collect personal information from children under thirteen. If you believe a child has provided us personal information, please contact us at contact@novate.ai and we will take steps to delete it.
12. Security
We use administrative, technical, and organizational measures designed to protect personal information against loss, misuse, unauthorized access, disclosure, alteration, and destruction. No method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting your information, we will notify you and any applicable regulators as required by law.
13. Third-Party Links and Integrations
The Services may contain links to third-party websites, products, or services. This Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review their privacy policies before interacting with them.
14. Do Not Track
Some browsers offer a "Do Not Track" signal. Because no common industry standard for responding to Do Not Track signals has been adopted, we do not currently respond to them. We respect the preferences you set through our cookie banner and through any applicable opt-out mechanisms described above.
15. Changes to This Policy
We may update this Policy from time to time to reflect changes in our practices, the Services, or applicable law. When we make material changes, we will update the "Last Updated" date above and, where appropriate, provide additional notice (for example, by posting a notice on the Site or sending you an email).
